Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes prohibited uses of Akol services. Violation of this policy may result in suspension or termination of your account.

Policy Violations Are Taken Seriously

Violations of this policy may result in immediate account suspension, permanent termination, and reporting to law enforcement where applicable.

Prohibited Uses

You may NOT use Akol for any of the following:

Illegal Activities

  • Violate any applicable laws, regulations, or industry codes
  • Promote or facilitate illegal activities
  • Engage in fraud, deception, or misrepresentation
  • Launder money or finance terrorism

Spam & Unsolicited Communications

  • Make unsolicited telemarketing or robocalls
  • Send spam or bulk unsolicited messages
  • Violate the Telephone Consumer Protection Act (TCPA)
  • Use autodialers without proper consent
  • Call numbers on Do Not Call lists without exemption

Harassment & Abuse

  • Harass, bully, or intimidate any person
  • Make threats of violence or harm
  • Stalk or unlawfully monitor others
  • Discriminate based on protected characteristics

Deceptive Practices

  • Impersonate any person, business, or entity
  • Misrepresent the nature of AI-generated communications
  • Create misleading caller ID information (spoofing)
  • Engage in phishing or social engineering

Privacy Violations

  • Collect personal data without proper consent
  • Record calls without required disclosure/consent
  • Share personal data without authorization
  • Violate data protection laws (GDPR, CCPA, etc.)

Harmful Content

  • Promote violence, hatred, or discrimination
  • Distribute obscene or pornographic content
  • Facilitate child exploitation in any form
  • Glorify self-harm or suicide

Security Violations

  • Attempt to gain unauthorized access to systems
  • Distribute malware, viruses, or harmful code
  • Interfere with the operation of our services
  • Probe, scan, or test system vulnerabilities
  • Bypass rate limits or usage restrictions

Intellectual Property

  • Infringe copyrights, trademarks, or patents
  • Distribute pirated content
  • Reverse engineer our software or AI models

Industry-Specific Requirements

Healthcare

  • Comply with HIPAA and applicable health privacy laws
  • Have a signed BAA in place before processing PHI
  • Use HIPAA-enabled features and configurations

Financial Services

  • Comply with applicable financial regulations
  • Follow required disclosure requirements
  • Maintain required records and audit trails

Legal Services

  • Maintain attorney-client privilege requirements
  • Comply with bar association rules
  • Ensure proper confidentiality protections

TCPA Compliance

Telephone Consumer Protection Act

Federal law governing telemarketing and automated calls

When using Akol for outbound calls or automated communications, you must comply with the TCPA:

Obtain prior express consent before making calls

Honor the National Do Not Call Registry

Maintain an internal Do Not Call list

Identify yourself and your business at the start of calls
Required
Provide a way for recipients to opt-out of future calls
Required
Respect calling time restrictions (8 AM - 9 PM recipient's local time)

Keep records of consent for at least 5 years

Penalties: TCPA violations can result in statutory damages of $500-$1,500 per violation. You are responsible for ensuring your use of Akol complies with the TCPA.

AI Disclosure Requirements

You must:

Disclose to callers that they are interacting with an AI

Comply with any AI disclosure laws in your jurisdiction

Not program the AI to deny it is artificial
Required
Provide a clear path for callers to reach a human
Required

Call Recording Compliance

If you enable call recording:

Comply with all applicable recording consent laws
Provide required notifications to callers before recording begins
Obtain explicit consent from all parties in two-party consent states
Maintain records of consent where required

Two-Party Consent States

The following states require consent from all parties before recording a call. If any party to a call is in one of these states, you must obtain explicit consent:

Usage Limits

Fair Use Policy

Do not exceed your plan's usage limits
Do not abuse free trial or promotional offers
Do not share accounts between multiple businesses
Do not create multiple accounts to circumvent limits

Monitoring & Enforcement

Our Rights

We reserve the right to:

Monitor usage for compliance with this policy
Investigate reported or suspected violations
Remove or disable access to violating content
Suspend or terminate accounts for violations
Report illegal activities to law enforcement

Consequences

Violations may result in:

Temporary Suspension

Services temporarily disabled

Permanent Termination

Account permanently closed

We take all reports seriously and will investigate promptly.

Changes to This Policy

We may update this AUP at any time. Material changes will be communicated via email or dashboard notification. Continued use of the Service after changes constitutes acceptance of the updated policy.
